Please read these terms carefully. By purchasing or using MobileTracking, you agree to them. They set out how the software may be used and the responsibilities that come with it.

1. Acceptance of these terms

These Terms of Use ("Terms") form a binding agreement between you and MobileTracking ("we", "us", "our") governing your access to and use of our software, website and services (together, the "Service"). By creating an account, purchasing a subscription, installing the software or otherwise using the Service, you confirm that you have read, understood and agree to be bound by these Terms. If you do not agree, you must not use the Service.

2. Lawful and acceptable use

MobileTracking is a powerful monitoring tool intended for lawful purposes only. You are solely responsible for ensuring that your use of the Service complies with all laws, regulations and rules that apply to you and to the jurisdiction in which you and the monitored device are located.

You must obtain the consent of the device user, and provide any notice, wherever the law requires it. In many jurisdictions it is a criminal offence to monitor a device, intercept communications, or record calls or surroundings without proper authority or consent. It is your responsibility — not ours — to know and follow the law that applies to you.

You agree that you will not use the Service to monitor any person or device without the legal right to do so, to stalk, harass, threaten or harm any person, to intercept communications unlawfully, or for any other unlawful, fraudulent or malicious purpose. Installing monitoring software on a device you do not own or have no lawful authority over may be illegal.

We do not condone, and expressly prohibit, any use of the Service that is unlawful or that infringes the rights of others. We reserve the right to suspend or terminate any account that we reasonably believe is being used in breach of these Terms or applicable law, without refund and without notice where appropriate.

3. Eligibility

You must be at least 18 years old and capable of forming a binding contract to use the Service. By using the Service you represent that you meet these requirements and that the information you provide is accurate.

4. Your account

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to use a strong, unique password and to notify us promptly of any unauthorised use. We are not liable for any loss arising from your failure to safeguard your credentials.

5. Licence

Subject to these Terms and your payment of applicable fees, we grant you a limited, non-exclusive, non-transferable, revocable licence to use the Service for your own lawful purposes. You may not copy, modify, reverse-engineer, resell, sublicense or otherwise exploit the Service except as expressly permitted.

6. Subscriptions, billing and renewals

The Service is offered on a subscription basis. By purchasing, you authorise us to charge the applicable fees to your chosen payment method for the billing period you select (monthly, quarterly or annual). Subscriptions renew automatically at the end of each period at the then-current rate for your plan unless you cancel before the renewal date. We will send a reminder before renewal where required. Prices are shown at checkout and may be subject to tax.

7. Cancellation and refunds

You may cancel future renewals at any time from your account. Cancellation stops the next charge; you retain access until the end of the period already paid for. New purchases are covered by our refund policy. To request a refund, contact our support team and reference the purchase. Refund eligibility, time windows and conditions are as described at the point of sale and by our support team; refunds are not available for accounts terminated for breach of these Terms.

8. Device compatibility

Available features depend on the device, operating system and version. We make reasonable efforts to keep the Service working across supported devices but do not guarantee that every feature will be available on every device, or uninterrupted or error-free operation. Operating-system updates by device manufacturers may affect functionality.

9. Intellectual property

All rights, title and interest in the Service, including software, text, graphics and trademarks, belong to us or our licensors. Nothing in these Terms transfers any such rights to you except the limited licence expressly granted.

10. Disclaimers

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, to the fullest extent permitted by law. We do not warrant that the Service will meet your requirements, be uninterrupted, secure or error-free, or that data will always be captured, complete or accurate.

11. Limitation of liability

To the fullest extent permitted by law, we shall not be liable for any indirect, incidental, special, consequential or punitive damages, or any loss of data, profits or goodwill, arising out of or in connection with your use of the Service. Our total aggregate liability arising out of or relating to the Service shall not exceed the amount you paid us in the twelve months preceding the claim.

12. Indemnity

You agree to indemnify and hold us harmless from any claims, damages, losses or expenses (including reasonable legal fees) arising from your use of the Service, your breach of these Terms, or your violation of any law or the rights of any third party. Because you control how the Service is used, you bear responsibility for ensuring that use is lawful.

13. Termination

We may suspend or terminate your access to the Service at any time if you breach these Terms or use the Service unlawfully. Upon termination, your licence ends and you must cease using the Service.

14. Changes to these terms

We may update these Terms from time to time. Material changes will be notified by reasonable means. Your continued use of the Service after changes take effect constitutes acceptance of the revised Terms.

15. Governing law

These Terms are governed by the applicable laws of our place of operation, without regard to conflict-of-law principles. Any disputes shall be subject to the jurisdiction of the competent courts there, except where mandatory local law provides otherwise.
