Terms of Service

These terms of service are the agreement between you and MobileTracking when you use our app and website. Please read them. The short version: use MobileTracking to look after the phones of children in your care, with their knowledge, not to spy on other adults.

1. Acceptance of these terms

By creating an account, installing the app, or using this website, you agree to these Terms of Service and to our Privacy Policy. If you don’t agree, please don’t use the service.

2. Who can use MobileTracking

You must be at least 18 years old and legally able to enter into a contract. You may only use MobileTracking to monitor devices that you own or are legally responsible for, and that are used by a minor child in your care as their parent or legal guardian.

3. Acceptable use, the important part

MobileTracking is a parental-control tool. You agree that you will:

• Use it only on phones you own or are the parent or legal guardian responsible for.
• Use it only to monitor a minor child in your care, and inform that child that monitoring software is installed. The app is designed to be visible on the child’s phone for exactly this reason.
• Comply with all laws that apply to you, including any local laws about monitoring, privacy, and consent.

You agree that you will not:

• Install or use MobileTracking on the device of another adult, an employee, a partner, or anyone else, without their knowledge and consent.
• Use it to stalk, harass, threaten, or harm anyone.
• Use it for any unlawful purpose.

Monitoring another person without the legal right to do so may be a crime. You are solely responsible for how you use MobileTracking and for ensuring your use is lawful where you live. If we learn the service is being used to unlawfully surveil someone, we may suspend or terminate the account.

4. Your account

You’re responsible for keeping your login details secure and for everything that happens under your account. Tell us right away if you think someone else has accessed it. Keep your account information accurate and up to date.

5. The service

MobileTracking provides parental-control features such as location, screen time, web filtering, and alerts, as described on this website. We may add, change, or remove features over time. We work hard to keep the service reliable, but we don’t guarantee it will always be available, uninterrupted, or error-free.

6. Not a substitute for supervision

MobileTracking is a tool to help you, not a replacement for parenting, supervision, or emergency services. No monitoring app can catch everything or prevent every risk. Location can be delayed or inaccurate, filters can miss things, and alerts depend on the phone reporting. Don’t rely on MobileTracking alone in situations where a person’s safety is at risk, contact the appropriate authorities.

7. Subscriptions and billing

Some features require a paid subscription. Prices and plans are shown in the app or at checkout. Paid plans renew automatically unless cancelled, and you can manage or cancel from your account settings. Fees are charged through our payment provider. Except where required by law, payments are non-refundable. We’ll give notice of any price changes.

8. Intellectual property

MobileTracking, including the app, website, design, and content, is owned by us and protected by law. We grant you a limited, personal, non-transferable licence to use the service for your own family. You may not copy, modify, resell, reverse-engineer, or create derivative works from it, except where the law expressly allows.

9. Your content and data

You keep ownership of your data. By using the service, you give us the permission we need to store and process that data to provide the service, as described in the Privacy Policy. You’re responsible for having the right to collect the data you set up MobileTracking to collect.

10. Disclaimers

The service is provided “as is” and “as available,” without warranties of any kind, whether express or implied, including fitness for a particular purpose and non-infringement, to the fullest extent permitted by law. We don’t warrant that the service will meet every need or that results will be accurate or reliable.

11. Limitation of liability

To the fullest extent permitted by law, MobileTracking and its team won’t be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, profits, or goodwill, arising from your use of (or inability to use) the service. Where liability can’t be excluded, it is limited to the amount you paid us in the twelve months before the claim.

12. Termination

You can stop using MobileTracking and close your account at any time. We may suspend or terminate your access if you break these terms, use the service unlawfully, or to protect the service or other users. On termination, your right to use the service ends, and we will handle your data as described in the Privacy Policy.

13. Changes to these terms

We may update these terms of service from time to time. When we make material changes, we’ll update the date above and, where appropriate, let you know. Continuing to use the service after changes take effect means you accept the new terms.

14. Governing law

These terms are governed by the laws of the jurisdiction in which MobileTracking operates, without regard to conflict-of-law rules. You agree to the courts of that jurisdiction for any disputes, unless the law where you live gives you the right to bring a claim elsewhere.
